First of all, the profile of the worker must be taken into account: this type of work permit is intended for specific professional profiles (directors, managers, technical and/or qualified personnel, etc.).

The profile of the company that the worker will be working for also has to be taken into account. When hiring a highly qualified professional, the company must be in one of the following situations:
- Be a large company or group of companies
- Be an SME in a strategic sector
- Be a company that develops a business project of general interest
However, if a company is interested in hiring a graduate or postgraduate from prestigious universities and business schools as a highly qualified professional, it can take advantage of this permit regardless of the size of the company, or the sector or activity in which it operates.

- They must be 18 or older.
- This work permit is for citizens from outside the European Union.
- They must prove that they do not have a criminal record, either in Spain or in any other country.
- They cannot already be in Spain in an unregistered situation.
