The BOE of January 18, 2022 has published the Resolution of December 16, 2021, of the Undersecretariat, approving the standardized forms for applying for Spanish nationality due to residence in the Ministry of Justice and issuing instructions on their use, and which enters into force on January 19, 2022.
New application forms for Spanish nationality
These new official forms replace those approved by the Resolution of November 11, 2015.
Things to bear in mind concerning the new models:
In the first place, they gather together information for attributing the name and surnames with which the applicant will be registered, in order to speed up the swearing-in and registration of nationality. As such, a new Section 8 has been added to the application, in which the established field must be filled in with the name and the corresponding surname with which it will be registered in the Civil Registry in the event that Spanish nationality is granted.
Secondly, the modalities for electronic notification and data verification of the required documentation have been improved.
The standardized paper application forms will be provided by the Ministry of Justice to those interested. In addition, the new forms will be available in electronic format on the website of the Ministry of Justice for free download.
In relation to the documentation required from applicants for nationality, it should be noted that "it will be presumed that the consultation or obtaining of the following data is authorized by the interested parties unless their express and reasoned opposition has been recorded in the procedure, in which case the following data must be provided:
- Taking of a test at the Cervantes Institute (CCSE and DELE).
- Electoral registration data.
- Data from the Central Registry of Prisoners.
- Data referring to residence in Spain.
- Data concerning university and non-university degrees.
Consequently, the Resolution of the Undersecretariat of the Ministry of Justice of November 11, 2015, approving the standardized forms for application for nationality due to residence within the scope of the Ministry of Justice and instructions on their use, is repealed.
